Ohio's top court once again has refused to hear an appeal from the last abortion clinic in Dayton.
Women's Med Center has been fighting with the state to avoid closure of the and isn't taking "no" for an answer. The clinic is now looking for a federal court to step in.
The clinic requested a new temporary restraining order from a federal court, saying the actions from the state's health department are unconstitutional because Kettering clinic will be forced to close, thereby denying women their constitutional right to access to an abortion.
A couple of months ago, the Ohio Supreme Court said it wouldn't hear a case brought by the Women's Med Center of Dayton that challenged Ohio's rules for abortion clinics to have transfer agreements with a local hospital. The clinic faced losing its license as an ambulatory surgical facility because it didn't meet Ohio's requirements for hospital transfers and agreements with doctors who could help facilitate hospital care in an emergency. The Ohio Department of Health had revoked the center's license because it wouldn't get that written agreement.
